HO/SCHOOLSTATE

A HO conducts the DPH & in Ohio must:

• Be a neutral or impartial attorney

• Complete training provided by ODE

• Know IDEA, related federal/state regulations, & how federal/state courts interpret IDEA.

• Know how & be able to conduct hearings -- using standard legal practices.

• Know how & be able to make & write down decisions per appropriate standard legal practice.

A HO cannot:

• Be an employee of the school, ODE or any public agency educating caring for a child.

• Have a personal or professional interest in favoring one party -- during the DPH.

The HO's written decision includes:

• The reasons the filed complaint was defined as insufficient.

• A statement in clear language that the case has not been dismissed.

• A statement that the case cannot go to DPH until a DP notice is filed that contains all required info.

A resources list to help complete a complaint & correct anything deemed insufficient.
