FILE COMPLAINT:

 

Communicate all data in writing with dates.

 

File a complaint -- under IDEA law or regulations or Ohio Spec Ed laws:

• Anyone may file a complaint;

• Anyone may claim a violation under IDEA laws or regulations or Ohio's Spec Ed laws;

• Anyone may raise issues about a specific child qualifying for Spec Ed services or getting Spec Ed; OR

• Issues may be raised about a Spec Ed system that affects more than one child with a disability.

  

Complaints:

• may be less controversial than a DPH.

• can be resolved quickly at no cost.

• A concern (general inquiry) is not a complaint.

If a complaint is filed, identify violations made by the school with:

• State/Federal laws/regulations that apply to Spec Ed 

• Facts to base complaint.

The OEC will NOT accept the complaint, if the complaint is:

The complaint must claim a violation done no more than 1 year prior to the date when the complaint is received.

When the complaint is filed with the OEC then forward a copy of the complaint to the school.

If OEC finds whole complaint insufficient, it is NOT investigated.

If the whole complaint is not investigated then OEC sends an "insufficiency letter" to explain how to change the complaint & enable

OEC to accept/investigate the complaint.

If the violation occured <1 year from when the complaint is refiled,

the OEC will accept the complaint.
